In Arizona it states that nobody working in or seeking to
be elected to a public position shall accept a gift of more than ten dollars in
value in a single year from anybody. They are also not allowed to accept gifts
that are meant to influence them to act out of accord with their professional
duties or use their official status to secure anything valuable that is not
normally allowed to their position (National Conference of State Legislatures,
2013). The other laws concerning the receipt or giving of gifts in public
positions are clearly those of professional distancing from possible persuasion
or compromising of their authority. These are essentially to keep them from
being dishonest in their duties to the constituents of the state and to ensure
equality in treatment for all those they serve as elected officials.
From the culture of a small town, it makes it difficult
for some people to not offer gifts or accept gifts as many of the constituents
are of the small town mentality where people look out for each other. It is
also considered polite to offer a meal or something cool to drink to the local
law enforcement, especially during the hot summer months. Many of the small
towns in Arizona are patrolled and protected by the county Sheriff’s Offices
and many of them have the same policies regarding gifts. Policies in each of
these agencies state that they do not want their officers accepting gifts of
any kind. Again this is due to the very nature of law enforcement and their
need to stay unbiased in any situation in order to protect and serve all
constituents equally. Law enforcement must remain balanced to make the best and
most fair decisions for the good of the many, allowing the courts to do their
duties and decide based upon the facts gathered and presented by the officers
and attorneys. Having any part of this process compromised would give
unconstitutional enforcement of the law.
of these positions must keep a watchful eye on those under them to ensure gifts
are not being accepted for any reason. The employees must also maintain a high
level of integrity and not accept gifts. If the individual is extremely
aggressive in giving the gift, the public employee should be just as adamant
about not accepting it. For advice on how to properly handle the situation, the
employee could ask others for advice, especially that of their supervisor,
making them aware the individual is pushing the gift on the public servant
