Legal Analysis. Focus on: Chapters 29 and chapter 6.
1. Bob is an employee of Smart Accessories Company, a small business (35 employees). Bob’s
job is security. One day, Bob is in the store when he sees Carla, a customer, hurrying past the
cashier’s desk to the store’s front doors with a large tote purse that Bob recognizes as being
one that the store sells. Bob is quite sure he saw Carla come into the store without any purse,
but he is worried that his drowsiness might mean he is wrong. Bob has been sleepy at work for
the past few weeks, owing to medication he must take for a serious liver condition that was only
discovered by Bob’s doctor a few weeks ago. Carla is stopped by Bob just as she reaches the
door and leaves the store. Bob now sees the tag is still on the purse. He follows Carla down the
street and asks if Carla would come to the cashier’s desk which should only take a few minutes
to check on purchase of the purse. Carla hits Bob in his face with the purse and runs away with
it. Smart Accessories floor supervisor June sees Bob’s report the next day and asks Bob why
he waited until Carla was leaving the store to confront her? Bob explains about the medication
and drowsiness. June writes down what he says in her report and tells Bob that being alert is a
job requirement for security. She asks Bob if he needs to take the medication every day and he
says yes. She also asks if he needed medical attention for being hit by Carla and he says he is
fine. Two days later, Bob, still at home, receives a notice of termination sent in overnight mail
stating he is no longer meeting job requirements.
2. Inventory at the end of the week shows that a large purse matching the description of the one
Carla had when she left is missing and was not paid for. The next time Carla returns to the
store, she is told by Sharon, the manager, that Carla is not welcome to shop there, owing to the
purse incident. Carla shouts, “Are you accusing me of theft? I’m going to see a lawyer about
this!”
3. Bags and More Company also sells clothing accessories in the same part of the city as
Accessories Company. This is also a small business (38 employees). George the CEO of Bags
and More starts a website for Bags and More He uploads many pictures of well-known
celebrities and sports figures carrying totes and purses from Bags and More with prices next to
these items. and wearing scarves and capes and so forth to generate customer interest. To get
more customers, George starts to post anonymous reviews of Accessories Company, claiming
that their goods are not ‘authentic’ but mock ups of real trademarked goods or even stolen. He
also runs a sale on purses and totes, lowering prices by 75% and promises to hold that price for
five months. The CEO knows Bags and More will definitely lose money with such a long sale,
but his goal is to force Accessories Company to close owing to an inability to compete. George
the CEO also approaches Sharon, manager at Smart Accessories and suggests she join his
company. She says she has a five-year contract with one year left to go. George says he will
double her salary and give her a bonus of $50,000 for signing on, which should cover any legal
costs. Sharon agrees and quits Smart Accessories then starts working for Bags and More.
Respond to the following, with a legal analysis (legal terms but be explained, incorporate facts)
about what might be the ‘law’ that justifies a lawsuit (what tort or what employment law),
describe/define that law, and explain whether any lawsuit would be strong or weak and why
(apply to facts).
1.
Could Bob Sue Carla? Could Bob sue Smart Accessories? Explain
2.
Could Carla sue Smart Accessories? Explain
3.
Could Bags and More be sued by anyone? Who would be the plaintiffs? What would be
the torts?
Length (4-7 sentences) for each answer (what is the lawsuit about, who might win) depends on
complexity (is it obvious the case is strong or weak, if not explain the arguments about
interpretation/application of the law from both sides or why certain facts matter more than others
and so forth)
